It's important to correctly define someone who works for you as an employee or a contractor.  The Australian Tax Office (ATO) can rule that someone you have employed as an independent contractor is actually deemed to be an employee.

 

If the ATO rules that your "independent contractor" is actually an employee, you can be liable for a range of penalties including:

  • Deemed PAYG Withholding

  • Superannuation

  • Interest

  • Fines
